CMS Facility Initiated Transfer vs. State - Involuntary Transfer Rules: Required Notices

Summary

Participants will be provided with an overview of the requirements contained in the new Facility Initiated Transfer regulations (F623) governing notice requirements for transfers to the hospital when return to the facility is anticipated. They will learn how to distinguish between the federal and state definitions, as they conflict, and learn which forms to use for notices and under which circumstances. Additionally, the new resident notice requirements will be discussed. Lastly, participants will have the opportunity for Q&A.

Learner Objectives:

  • Identify the requirements contained in the new Facility Initiated Transfer regulations (F623) governing notice requirements for transfers to the hospital when return to the facility is anticipated.
  • Describe how to distinguish between the federal and state definitions, as they conflict, and learn which forms to use for notices and under which circumstances.
